Rebate Program for Region 5 Full-Voting Members

Board Policy Regarding Rebates for Full-voting Members
Adopted by the Board of Directors on January 21, 2010
To rebate administrative fees earned by NJPA from sales to its Full-voting Members, allowing these Members to use the funds to purchase further NJPA services or to make purchases off of NJPA bid contracts.
The only NJPA Members entitled to participate in the rebate program are those Full-voting Members defined by Minnesota Statutes § 123A.21 Subd. 3 and § 471.59 Subd. 1 within Governor's Development Region 5, (Cass, Crow Wing, Morrison, Todd, and Wadena Counties) on record as of January 1, 2010.
A rebate program shall be established beginning January 1, 2010. No administrative fees, other than those earned by NJPA from purchases and services made by Full-voting Members, shall be utilized by NJPA for the rebate program. Administrative fees are defined as net revenue received by NJPA after all revenue sharing has been accounted for.
Beginning January 1, 2010, one hundred percent (100%) of all administrative fees earned by NJPA through eligible purchases or services of each above-described Full-voting Member shall be available to them in the form of a rebate. Eligible purchases or services are defined as any of NJPA’s bid contracted products or services. The administrative fees, as they are earned by NJPA, shall be placed into a restricted account (an account payable) on behalf of each of the Full-voting Members as defined above. No Full-voting Member shall be entitled to a rebate of administrative fees, other than those earned by NJPA by virtue of the use of services or purchases made by that particular Full-voting Member.
Rebate funds shall be fully vested for use by Full-voting Members entitled to them as soon as they are earned by NJPA.
The rebate program may be discontinued or modified at any time and for any reason by the NJPA Board of Directors with little or no notice to Full-voting Members. NJPA’s offering a rebate program at one time does not guarantee that a rebate program will be available in the future. At no time shall Members be entitled to "cash out" their restricted account or use the funds in any manner other than to purchase further NJPA services or to make purchases off of NJPA bid contracts.
The first step in applying for the rebate program is for each eligible Full-voting Member to execute a Rebate Application. As part of the application, each Full-voting Member entitled to participate in the rebate program shall be required to acknowledge in writing that their participation in the rebate program will only be used for essential public and governmental purposes and shall agree to hold NJPA harmless. Members may not participate in the rebate program until a fully executed and approved application is received by NJPA.
The Board of Directors authorizes their Executive Director to have prepared an appropriate application form and procedures to carry forth this Board Policy.
